2. warsawflowers-sklep.pl is a shop which where you to buy flowers and decorative articles via the Internet and have them delivered.
3. In order to contact the shop, the customer can call 720829646 or send an e-mail to biuro@warsawflowers.pl.
4. This document contains general terms and conditions applicable to individual and business customers. These conditions apply to the commercial offer presented in the internet shop warsawflowers-sklep.pl
5. The offer of the shop warsawflowers-sklep.pl is based only on new products, free from physical and legal defects.

Placing orders

1. Orders are placed exclusively via the online shop warsawflowers-sklep.pl
2. Orders may be placed only for products included in the offer of warsawflowers-sklep.pl presented on the website. Orders can be placed 24 hours a day, 7 days a week.
3. The customer should select a product from the offer, specify the quantity of products by adding them to the basket and indicating the delivery address. The customer must also select a payment method.

5. If the given data are incorrect or prevent delivery of the order warsawflowers-sklep.pl reserves the right to cancel the order after trying to contact the customer by phone to determine the correct data.
6. The customer is responsible for all consequences resulting from placing an incorrect order, i.e. in particular ordering different items than intended, providing an incorrect number of items, providing false or non-existent data.
7. Until the order is confirmed by clicking the Buy Now button, the customer can modify the order or the selected payment methods via the Internet.
8. Clicking the Buy Now button is tantamount to final confirmation of the order. After placing the order, the customer will receive a confirmation of the order to his e - mail address. The customer placing an order enters into a contract of sale of the ordered goods with warsawflowers-sklep.pl online shop.
9. warsawflowers-sklep.pl only carries out orders correctly paid in cash in the stationary shop, by electronic payment PAYU.
10. In the case of decorative items (excluding plants) it is possible to pay cash on delivery. If you choose cash on delivery, your order will be processed before it is paid for.
11. The online shop warsawflowers-sklep.pl reserves the right to refuse orders that have been filled in a way that raises doubts of the shop, which doubts have not been clarified during direct contact with the shop.
12. After placing an order, the customer will receive an email with an automatic confirmation of the order and an order number. In contact with the shop the customer should use the order number.
13. The place of performance related to the purchase of products on warsawflowers.co.uk is the delivery address indicated by the customer.
14. Each product composed of live plants and flowers is unique and may differ from the one pictured.
15. Whenever possible we deliver floral packages identical to the product photos. However, in certain circumstances it may be necessary to replace one product with another to maintain the composition of the whole bouquet and to deliver it on time. We always try to keep the changes as small as possible.

Lead times

1. Cut flower deliveries are done on the same day if the order is placed and paid for by 11:00 a.m. However, delivery cannot be made earlier than three hours after the order is successfully placed. Deliveries of cut flowers that have not been ordered and paid for by 11:00 a.m. will be made on the day indicated by the customer, not earlier than the next working day after the order has been placed and paid for.
2. For other shipments, delivery time is up to 2 working days.
3. When placing an order, the Customer is obliged to provide the telephone number of the recipient as well as the date of delivery and the time period in which the delivery is to be made.
4. The shop warsawflowers-sklep.pl does not make deliveries on public holidays. Orders placed on these dates will be fulfilled on the first working day or on the date indicated by the Sender.
5. Delivery, collection in person, cost of delivery and transport
6. Deliveries are made by the warsawflowers-sklep.pl shop's own transport, which guarantees that the products will be delivered intact.
7. Personal pick-ups take place after prior payment, pick-ups take place at the registered office of WARSAW FLOWERS at 45 Potażowa Street, 02-400 Warsaw at a previously agreed time. The order shall be available for pick-up for 24 hours counted from the established time of pick-up. After the specified time and if the order is not picked up, the order is considered cancelled and payment for the order is not refundable.
8. The shop warsawflowers-sklep.pl delivers its products only within the administrative borders of Warsaw and the nearest neighbourhood bordering Warsaw, within a radius of 20 km counted from the centre of Warsaw.
9. warsawflowers-sklep.pl offers free delivery for shipments over 1000 PLN. In case of orders of lower value, the cost of delivery depends on the recipient's Warsaw district or non-Warsaw address as below:

• The cost of delivery is 25 PLN and applies to the following districts: Śródmieście, Żoliborz, Wola, Ochota, Mokotów, Włochy, Ursus, Bemowo, Bielany.
• Delivery cost 30 PLN, applies to districts: Ursynów, Wilanów, Wawer, Wesoła, Rembertów, Praga, Targówek, Białołęka.
• Delivery cost 35 PLN, applies to addresses outside Warsaw in the following towns: Piastów, Pruszków, Komorów, Ożarów Maz., Ołtarzew, Borzęcin Duży, Bronisze, Babice.
• Cost of delivery 40 PLN, applies to addresses outside of Warsaw in the following locations: Łomianki, Marki, Ząbki, Sulejówek, Konstancin-Jeziorna.

Delivery

1. On the indicated day, the courier makes one delivery attempt.
2. In case of an ineffective attempt to deliver the product due to the recipient's non-availability at the indicated address or the recipient's refusal to accept the order and lack of contact with the Customer placing the order - the order is transported to the registered office of WARSAW FLOWERS at 45 Potażowa Street, 02-400 Warsaw and remains available for collection for 24 hours counted from the time of the ineffective attempt to deliver the product. After the mentioned time, and if the order is not collected, the order is considered cancelled. Payment for the order is not refundable, it is accepted as a compensation for the shop's loss.
3. Signing the protocol of receipt of the consignment and lack of remarks reported to the courier is the same as acceptance of the method of delivery of the consignment and lack of objections to the received consignment.
4. warsawflowers-sklep.pl is not responsible for flower deliveries that are delayed or undelivered due to incorrect address data provided by the customer or lack of payment for the order, unless the customer placing the order has chosen payment on delivery.
5. Upon delivery of the ordered goods to the customer, the benefits and burdens of the goods in question as well as the risks, including the danger of accidental loss of or damage to the ordered goods, are transferred to the customer.
6. Content provided by the sender of the shipment
7. The sender of the shipment has the option of forwarding the message to the recipient via the warsawflowers-sklep.pl shop.
8. Message means a text (not longer than 180 characters) that will be printed or handwritten and attached to the parcel
9. The text may not contain content that is offensive, pornographic, alludes to violence and hate speech. It is prohibited to communicate in any form of racial prejudice, nationality, armed conflict or content that may cause disgrace to the sender.
10. In case of violation by the Sender of the rules listed in pt. 4D warsawflowers-skleplep.pl reserves the right to refuse to deliver the text message and will inform the Sender.

Payments

1. Each product offered on the shop's website has a specific price. The presented price is the final price, expressed in Polish zloty, and includes the appropriate VAT rate for the product category. The price presented to the customer during the transaction on the website is a binding price. The price presented does not include the cost of delivery of the order. The cost of delivery of an order is indicated when finalizing the order, before placing it.
2. The shop warsawflowers.pl handles payments in cash, by credit card or by means of Shoper electronic payment transfers.
3. The online payment service provider is Blue Media S.A.

In the event that a refund is necessary for a transaction made by the customer with a payment card, the seller will make the refund to the bank account assigned to the customer's payment card.

Along with the ordered goods the customer will receive a purchase confirmation in the form of a receipt. On request, a VAT invoice will be issued.

In the case of payment by credit card, the order processing time depends on the moment of obtaining a positive authorisation. If the Sender indicates a delivery date earlier than the date of obtaining authorisation, the order will be processed on the first following day.

Withdrawal from the contract

1. The customer has the right to withdraw from the concluded contract without giving any reason and without incurring costs, except for the costs indicated in these regulations within a period of 14 days.
2. The withdrawal period shall expire 14 days from the day on which the customer has acquired possession of the purchased goods or on which a third party other than the carrier and indicated by the customer has acquired possession of the goods.
3. Sending your notice of withdrawal before the deadline expires shall be sufficient to meet the deadline.
4. The customer may use the model declaration of withdrawal, but it is not obligatory.
5. In order to exercise the right to withdraw from the contract, the customer must inform the shop warsawflowers-sklep.pl of this fact by an unequivocal statement of withdrawal, which shall be sent in writing to the address WARSAW FLOWERS Milena Felczak, 45 Potażowa Street, 02-400 Warszawa.
6. In the event of a declaration of withdrawal by the customer, the contract shall be deemed not to have been concluded.
7. Shop warsawflowers-sklep.pl will immediately, but not later than within 14 days from the date of receipt of the customer's statement of withdrawal from the contract, return to the customer all payments made by him, including the costs of delivery of the items.
8. The shop warsawflowers-sklep.pl shall refund the payment using the same means of payment used by the customer, unless the customer has expressly agreed to a different method of refund which does not involve any costs for the customer.
9. The shop warsawflowers-sklep.pl may withhold reimbursement of payments received from the customer until it has received the item or until it provides proof of return, whichever event occurs first.
10. The goods shall be sent back to the address of WARSAW FLOWERS Milena Felczak, ul. Potażowa 45, immediately, but not later than within 14 days of the date on which the customer has withdrawn from the agreement. In order to meet the deadline, it is sufficient to send the items back before its expiry.
11. The customer shall bear the direct costs of returning the item. If the item cannot be returned by post in the usual way due to its nature, the customer will be informed of the cost or estimated cost of returning the item before placing the order.
12. The Customer shall be liable for any diminution in the value of the goods resulting from their use beyond what is necessary to establish the nature, characteristics and functioning of the goods. Returned goods should be undamaged, complete, unused, in a condition allowing its further resale, and moreover packed in a way ensuring no damage to the parcel during transport.
13. The customer has no right of withdrawal in relation to contracts:

• in which the object of the supply is a non-refabricated item produced to the consumer's specifications or intended to meet his individual needs,
• in which the object of the performance is an item that deteriorates rapidly or has a short shelf life, i.e. in particular cut flowers and other plants,
• in which the subject-matter of the supply is an item which is inseparable from other items after delivery,

Complaints

The shop warsawflowers-sklep.pl is obliged to deliver things free from defects. If the sold thing has a defect, the customer, according to and within the limits of applicable regulations, may:

• make a declaration of price reduction,
• declare a withdrawal from the contract, but this right shall not arise if the defect is insignificant,
• require the item to be replaced with a defect-free item,
• request the rectification of defects.

1. All product defects that are the basis for complaint should be reported to warsawflowers-sklep.pl immediately after their discovery. Information about the defects should be given in writing with an attached photo of the advertised product.
2. Complaints should be submitted in writing to WARSAW FLOWERS Milena Felczak, 45 Potażowa Street, 02-400 Warsaw.
3. Shop warsawflowers-sklep.pl undertakes to consider the complaint within 14 working days from the moment of notification.
4. Complaints about cut and potted flowers can only be made upon receipt of the parcel from the courier or immediately upon receipt of the parcel.
5. Each complaint is considered individually. The basis for consideration of a complaint regarding a product composed of fresh flowers is the photo documentation sent by the Sender.
6. In order to exercise the warranty rights, the customer must present proof of purchase.
7. The shop warsawflowers-sklep.pl is liable under the warranty if a defect is found before the expiry of two years from the delivery of the item to the customer.
8. The shop warsawflowers-sklep.pl is not responsible for any kind of damage resulting in particular (from accidental or intentional) damage to the item done by the customer, or improper use of the item.
9. A customer who is not a consumer as defined by generally applicable law is excluded from the rights arising from the warranty for defects of the goods sold.
10. The Customer has the possibility to use out-of-court complaint resolution and dispute resolution methods in accordance with the rules indicated on the uokik.gov.pl website under "Out-of-court resolution of consumer disputes".

Final provisions

1. By accepting the terms and conditions of warsawflowers-sklep.pl online shop, customers agree to the use and processing of their personal data for the purpose of carrying out the order.
2. In matters not covered by these Terms and Conditions, provisions of generally applicable Polish law shall apply, i.e. in particular the Act on Consumer Rights and provisions of the Civil Code.
3. The service provider reserves the right to make changes to the Terms and Conditions for important reasons, i.e.: changes to the law; changes to the methods of payment and delivery - to the extent that these changes affect the implementation of the provisions of these Terms and Conditions.
4. Any disputes arising from contracts concluded by the customer with the shop shall be settled by the common courts with jurisdiction according to the provisions of general or alternate jurisdiction of common courts.
