Privacy Policy

All personal data is collected and stored in accordance with the provisions of Regulation 2016/679 of the European Parliament and of the Council of 27th April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (hereinafter: "RODO") and the Act of 18th July 2002 on the provision of electronic services.

Use of data

All personal data collected on the website www.warsawflowers.pl is used to the extent necessary only for the technical administration of the website, individual support, user administration and for marketing and dispatch of ordered goods and newsletters.

 

Personal data, such as your name, email address, as well as your delivery address and telephone number and, in the case of companies, your VAT number, is provided by you voluntarily, but is necessary primarily for

  • to conclude a sales contract with you and to process and fulfil your order (legal basis art. 6(1)(b) RODO) - for the duration of the concluded contract and settlements after its completion;
  • to comply with the Administrator's legal obligations (legal basis Article 6(1)(c) of the DPA), including:
  1. issuing and keeping a personal sales document (invoice, receipt) - for the period during which we are required by law to keep tax documents,
  2. servicing and processing of possible complaints - until the end of the guarantee or warranty period for the products purchased from us;
  3. pursuing our legitimate interests (legal basis Article 6(1)(f) RODO), i.e.:
  • direct marketing - for no longer than 5 years or until you object to the processing of your personal data;
  • selection of services for our customers, optimisation of our products or services on the basis of customer feedback, optimisation of service processes on the basis of sales and after-sales service processes - analytical purpose;
  • customer satisfaction surveys and determining the quality of our service;
  • to compile statistics and analyses for our internal use - for the period that we keep your data for the other purposes indicated in this privacy policy.

 

For the purposes indicated above (in addition to "performance of a contract" and "performance of legal obligations"), we will carry out profiling, i.e. automated analysis of your data and making predictions about your preferences or future behaviour (e.g. in the case of marketing profiling, we will tailor advertising messages to your needs and preferences).

 

In cases where you consent to the processing of your data, the content of this consent will include the purpose for which we will process the data. For example, you may voluntarily consent to the processing of your personal data also for marketing purposes, including the receipt of commercial information (e.g. newsletters, information on promotions, etc.), as referred to in the Act of 18.07.2002 on the provision of services by road, as well as to contact the Service Provider by means of telecommunication terminal equipment and automatic calling systems for the purposes of direct marketing, in accordance with the Act of 16.07.2004. Telecommunications Law.

 

The provision of your personal data is voluntary, but necessary in order to place an order, subscribe to a newsletter, or simply contact us, etc.

 

Who can we share data with?

We may pass your data to other companies with whom we cooperate, i.e.: courier companies, payment operators, companies operating our warehouses, hosting companies (they store data for us on their servers), suppliers and partners in providing services related to marketing and advertising, law firms, debt collection companies, entities acquiring debts.

 

The above processing may also result in data being transferred to data recipients outside the European Union. The transmission of data in this respect shall take place in accordance with the principles of the so-called Privacy Shield (https://www.privacyshield.gov/welcome) or on the basis of the so-called Standard Contractual Clauses of the European Commission (http://ec.europa.eu/justice/data-protection/międzynarodowy transfer / transfer / index_en.htm).

 

User rights

The user whose data is processed has the right:

  • to have access to their personal data and to receive a copy thereof,
  • to rectify their personal data if it is inaccurate, and to complete it if it is incomplete,
  • to completely delete your personal data (the right to be forgotten),
  • to restrict the processing of your data,
  • to object to the processing of your data for analytical and statistical purposes,
  • to lodge a complaint with the President of the Data Protection Authority (if they consider that the processing of their data violates the provisions of the RODO).

 

The Administrator guarantees the confidentiality of any personal data provided. He shall ensure that all security and personal data protection measures required by the provisions on the protection of personal data are taken. Personal data shall be collected with due care and properly protected against access by unauthorised persons.

  1. The shop does not automatically collect any information except that contained in cookies
  2. Cookies are computer data, in particular text files which are stored on the User terminal equipment of the Store and are intended for use on the Store’s websites. Cookies usually contain the name of the website they come from, the time they are stored on the end device and a unique number.
  3. The Store operator is the entity placing cookie files on the Store User's terminal equipment and accessing them.
  4. Cookies are used for:
  • adjusting the content of the Store's websites to the User's preferences and optimise the use of the websites; in particular, these files allow the Store to recognise a User's device and properly display the website, adjusted to the User's individual needs;
  • generating statistics which help to understand how Shop Users use websites, which enables improving their structure and content;

  • "functional" cookies, which allow "remembering" the User's selected settings and personalizing the User's interface, e.g. with regard to the chosen language or region of origin of the User, the font size, the appearance of the website, etc;
  • "advertising" cookies, enabling the delivery of advertising content to Users more tailored to their interests.
  1. In many cases, the software used to browse the Internet (web browser) allows the storage of cookies on the User's end device by default. Users of the Shop can change their cookie settings at any time. These settings can be changed in particular in such a way as to block the automatic handling of cookies in the browser settings or inform on their placement on the device of the Shop User each time.   2. The Shop Operator informs that restrictions on the use of cookies may affect some of the functionality available on the Shop's websites.
